On Wednesday, March 12th, 2014 at about 10:30pm, officers were dispatched to the Right Here C-Store in the 400 block of north Glenn English on a report of an intoxicated male at the drive through window.
An officer was able to make contact with Mr. Smith in the parking lot.
During the initial contact, Mr. Smith became hostile in answering the officer's questions by assuming an aggressive posture and shouting. The officer attempted to detain Mr. Smith by placing him in hand restraints due to his unpredictable behavior and apparent state of intoxication. This is when Mr. Smith forcibly pulled away from the officer and fought any attempts to be detained. The altercation went to the ground as the officer attempted to gain compliance. The violent behavior continued even as emergency medical personnel attempted treat Mr. Smith, who had complained of injury during his altercation with the officer.
According to the arrest affidavit Smith, “became violent and began to kick and lunge forward resulting in the chair[ambulance cot] collapsing, nearly causing injury to both EMS personnel and himself as he shouted profane language out in public causing a disturbance”. The affidavit states that Mr. Smith smelled of alcohol and displayed signs of being intoxicated. After being placed in the patrol car “[Smith] began to scream hysterically and violently move uncontrollably in an effort to free himself”.
Mr. Smith was arrested on several charges and transported to the Washita County Justice Center. The officer involved in the altercation received no major injury.
